1. Acceptance of Terms

By accessing or using BuilderConnect, including any website, application, or service provided by BuilderConnect (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These Terms apply to all builders, trade contractors, and other users.

2. Description of Service

BuilderConnect is a construction project management platform designed for residential and light commercial builders. The Service allows users to create projects, invite trade contractors, collect and compare bids, share files, manage change orders, track milestones, and integrate with third-party accounting tools such as QuickBooks Online.

3. User Accounts and Responsibilities

• You must provide accurate, current, and complete account information and keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must be at least 18 years old and have the authority to bind any business entity you represent.
• Builder accounts are responsible for the accuracy of project information, invitations sent, and bids accepted.

4. Acceptable Use

You agree not to use the Service to:

• Post, upload, or transmit content that is unlawful, fraudulent, defamatory, or harmful.
• Harass, abuse, or impersonate others, or collect information about users without consent.
• Interfere with the security, availability, or integrity of the Service, including attempts to access data or systems without authorization.
• Use the Service to manage projects or bids in violation of applicable laws, licensing requirements, or contractual obligations.

5. Intellectual Property

BuilderConnect and its content, features, branding, software, and design are owned by BuilderConnect and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any project data, documents, and bids you upload; you grant BuilderConnect a limited license to host, display, and process that data solely to provide and improve the Service.

6. Limitation of Liability

To the fullest extent permitted by law, BuilderConnect and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to liability. BuilderConnect is not a party to any contract between builders and trade contractors and does not guarantee the performance, quality, or pricing of any bid or project.

7. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms or if continued provision of the Service is commercially impractical. Upon termination, your right to access the Service ceases; however, provisions related to intellectual property, limitation of liability, and governing law shall survive.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina and the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in South Carolina.

9. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
